This terms of use (together with the documents referred to in it) tell you the terms of use on which you may make use of our website www.fruistshoot.com and our Fruit Shoot mobile application (our “Site”), whether as a guest or a registered user. Use of our Site includes accessing, browsing, or registering to use our Site.

By using our Site, you confirm that you accept these terms of use and that you agree to comply with them.

If you do not agree to these terms of use, you must not use our Site.

However, please note that any of the content on our Site may be out of date at any given time, and we are under no obligation to update it. USING THE FRUIT SHOOT MOBILE APPLICATION

Depending on the version of the Fruit Shoot mobile application (the “App”) you have downloaded, your use of the App shall also be governed by Apple’s or Google Android’s Terms and Conditions and Privacy Policies (“Platform Terms”). If there is any conflict between these terms and the Platform Terms then these Terms will control.

If you are under 13, you should seek the consent of your parent or guardian to use the App.

We grant you a non-exclusive, non-transferable, revocable licence to use the App for your personal, non-commercial use and only on an Apple or Android device (“Device”) as permitted by the applicable Platform Terms and these terms. All other rights in the App are reserved by Britvic and its licensors. You are responsible for ensuring that all persons accessing using our App on your Device are aware of these Terms.

You acknowledge that your agreement with your mobile network provider (“Mobile Provider”) will also apply to your use of the App. You also acknowledge that you may be charged by the Mobile Provider for data services or any other third party charges as may arise while using certain features of the App and you accept responsibility for such charges. If you are not the bill payer for the Device being used to access the App, then you must seek permission from the bill payer and we will assume that you have received permission to use the App from the bill payer.

 

ACCESSING OUR WEBSITE

Our Fruit Shoot website at www.fruitshoot.com (the “Website”) is made available free of charge.

We do not guarantee that our Website, or any content on it, will always be available or be uninterrupted. Access to our website is permitted on a temporary basis. We may suspend, withdraw, discontinue or change all or any part of our Website without notice. We will not be liable to you if for any reason our Website is unavailable at any time or for any period. You are responsible for making all arrangements necessary for you to have access to our Website. You are also responsible for ensuring that all persons who access our Website through your internet connection are aware of these terms of use and other applicable terms and conditions, and that they comply with them.

 

AVAILAIBILITY & USE OF THE SITE

You acknowledge that we cannot guarantee that the Site will:

(b) access the Site via a means not authorised in writing in advance by Britvic, including but not limited to, automated devices, scripts, bots, spiders, crawlers or scrapers (except for standard search engine technologies);

(c) attempt to restrict another user of the Site from using or enjoying the Site and you must not encourage or facilitate the breach of these terms of Use by others;

(d) use the Site for any illegal or unauthorised purpose; or

(e) change, modify, adapt or alter the Site or change, modify or alter another website so as to inaccurately imply an association with the Site or with Britvic.

YOUR ACCOUNT AND PASSWORD

APPLICABLE LAW

If you are a consumer, please note that these terms of use, its subject matter and its formation, are governed by English law. You and we both agree to that the courts of England and Wales will have non-exclusive jurisdiction. However, if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident of Scotland, you may also bring proceedings in Scotland.

If you are a business, these terms of use, its subject matter and its formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales.
